Terms of Service

1. The agreement

These Terms form a binding agreement between you (or the organization you represent) and Manda Labs. If you accept these Terms on behalf of an organization, you confirm you have authority to do so.

2. The Service

Manda provides an AI-powered marketing analytics platform that lets you connect ad and commerce platforms, ingest performance data, and ask natural-language questions to generate insights and visualisations. Features and integrations may evolve; we will not materially reduce the Service for paying customers without notice.

3. Accounts

You are responsible for keeping your credentials confidential and for all activity on your account. Notify us at security@mandalabs.ai if you suspect unauthorized access. You must be at least 18 to register.

4. Acceptable use

You agree not to:

• Use the Service to violate any law or third-party right;
• Reverse-engineer, scrape, or rate-abuse the Service;
• Upload data you are not authorised to process;
• Attempt to extract another customer’s data;
• Use the Service to build a competing product.

5. Your data

You retain all rights in the data you upload or connect ("Customer Data"). You grant Manda a limited licence to process Customer Data solely to operate the Service for you. Our data-handling commitments are detailed in the Privacy Policy and our Data Processing Addendum.

6. AI outputs

AI-generated insights and chart suggestions ("Outputs") are advisory. They may be incomplete or inaccurate. You are responsible for evaluating Outputs before acting on them. We do not warrant that Outputs are fit for any particular purpose, and we do not use your prompts or Outputs to train third-party AI models.

7. Fees and trials

Paid plans are billed in advance through Stripe. Free trials end automatically; you can cancel anytime before the trial ends. Refunds are at our reasonable discretion and not provided for partial billing periods.

8. Intellectual property

Manda and its licensors own all rights in the Service, including software, design, and documentation. We grant you a non-exclusive, non-transferable right to use the Service during your subscription.

9. Disclaimer

The Service is provided "as is". To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Liability

Neither party is liable for indirect, special, or consequential damages. Our aggregate liability for any claim arising from or related to the Service will not exceed the fees you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. fraud, gross negligence, or breach of GDPR).

11. Termination

You can cancel at any time from Settings. We may suspend or terminate your account for material breach of these Terms with reasonable notice where practicable. On termination we will delete or return your Customer Data per the Privacy Policy.

12. Governing law

These Terms are governed by the laws of Israel. Disputes will be resolved in the competent courts of Tel Aviv-Yafo, except where mandatory consumer protection law in your jurisdiction provides otherwise.
